Terms of Service

These terms (“Terms”) cover https://www.memori.cam, related Memori websites, and the Memori mobile apps for iOS and Android (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
We also have a Privacy Policy at https://www.memori.cam/privacy.
1. Who may use the Service
- You must be 13 or older.
- If you are under the age of majority in your region, a parent or guardian must accept these Terms for you.
- You may use the Service on behalf of an organization only if you have authority to bind that organization. “You” includes that organization.
2. Your account and guests
Accounts
Some features — such as creating and managing events — require an account. On the website you may sign up with email and password. On the mobile apps you may also sign in with Apple or Google. Keep your credentials secure. You are responsible for activity on your account.
Tell us right away at support@memori.cam if you suspect unauthorized use.
Guests (no account required)
Guests may join an event using an invite link or QR code and a display name. Guests do not need to create a Memori account to take photos or view a revealed gallery. Optional email may be collected only if a guest asks to be notified when the gallery opens.
3. Purchases and refunds
- You can purchase increased guest capacity, shot limits, or related event offerings. Prices and taxes are shown at checkout.
- On the website, payments are processed by Stripe. Their terms apply to the payment process.
- On iOS and Android, in-app purchases are processed by Apple or Google (validated via RevenueCat where applicable). Their store terms and refund rules apply.
- All purchases are final except where required by law (including applicable EU consumer withdrawal rights where they apply) or when a technical issue we control prevents use. Email support@memori.cam within 14 days with your transaction ID and a description of the issue.
4. Permissions and device access
- Camera is used only when you take a photo. Photo library access is used only when you choose to save or select a photo. Permissions are required by your device OS.
- Push notifications are optional and can be managed in your device or app settings.
- You are responsible for your mobile data and carrier charges.
5. Your content and events
Ownership
You own the photos you upload.
License to Memori
To operate the Service, you grant Memori a worldwide, royalty-free license to host, process, transmit, display, and back up your photos and event data as needed to run the Service.
Event hosts
If you create an event:
- You control access via invite links or codes and can set visibility, participant limits, and reveal timing.
- You get a non-exclusive license to use photos uploaded into your event only for running, viewing, sharing, and exporting that event for personal, event, or internal purposes. Any commercial use requires permission from the uploader.
Participants
If you join another user’s event:
- You keep ownership of your photos.
- You grant the event host the limited license described above.
- Your photos may be visible to other participants based on the event’s settings (including after the gallery is revealed).
Do not upload content you do not have the right to share. We may remove content or suspend accounts that violate these Terms or the law.
Not a backup service. Keep your own copies of important photos.
6. Acceptable use
Do not:
- Break the law, violate others’ rights, or upload unlawful, infringing, harassing, hateful, pornographic, or excessively violent content.
- Upload others’ photos without permission.
- Attempt to reverse engineer, interfere with, disrupt, or overload the Service.
- Use bots, scrapers, or unauthorized automation.
- Impersonate someone or misrepresent your affiliation.
7. Intellectual property, feedback, and third parties
The Service, including its branding, design, and software (other than your content), is owned by Memori or its licensors. Feedback you send may be used to improve the Service without obligation to you.
We use vendors such as Supabase (database, auth, storage), Stripe (web payments), RevenueCat (mobile purchase validation), PostHog (analytics), and Vercel (hosting). Their services are provided under their own terms. We are not responsible for third-party websites or materials.
8. App Store terms
Apple
These Terms are between you and Memori, not Apple. Apple is not responsible for the app. Apple has no duty to provide support. If the iOS app fails to conform to any warranty, you may notify Apple for a refund of the app price, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. For iOS downloads, Apple’s Licensed Application End User License Agreement (LAEULA) may also apply. If there is a conflict, the LAEULA controls to the extent required by Apple.
These Terms are between you and Memori, not Google. Your use of the Android app must follow Google Play policies. Google is a third-party beneficiary of these Terms and may enforce them.
9. Copyright notice
If you believe content on the Service infringes your copyright, email support@memori.cam with a notice that includes: (1) your contact info, (2) the work claimed infringed, (3) the specific URL or location of the material, (4) a good-faith statement that the use is not authorized, (5) a statement under penalty of perjury that your notice is accurate and you are the owner or authorized agent, and (6) your physical or electronic signature. We may terminate repeat infringers.
10. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some regions do not allow disclaimers; you may have rights that cannot be waived, including under EU consumer law.
11. Limitation of liability
To the extent not prohibited by law: (a) we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; and (b) our total liability for any claim is limited to the amount you paid to Memori for the Service in the 6 months before the claim. These limits apply even if a remedy fails its essential purpose. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or fraud).
12. Indemnity
You will defend and hold Memori harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the Service, or your violation of these Terms or the law, to the extent permitted by applicable law.
13. Termination
You may stop using the Service at any time. You may delete your account as described in our Privacy Policy. Deleting your account does not refund purchases. Ended events you host that are not yet revealed may be revealed when your account is deleted; revealed event content may remain available to participants without your account. We may suspend or terminate your access, or remove content, if we believe you violated these Terms or the law. Sections that by their nature should survive termination do survive.
14. Changes to these Terms
We may update these Terms. If we make material changes, we will notify you in-app or by email when reasonably possible. Continued use after the effective date means you accept the new Terms.
15. Governing law
These Terms are governed by the laws of France, without regard to conflict-of-laws rules. Courts in France have jurisdiction, subject to any mandatory rights you have as a consumer in your country of residence (including under EU consumer protection law).
16. Other terms
- Severability. If a term is unenforceable, the rest remain in effect.
- Assignment. We may assign these Terms. You may not assign without our consent.
- No waiver. A failure to enforce a term is not a waiver.
- Language. The English version controls.
